E Way Bill now mandatory for movement of gold, precious metal within Kerala

Kerala has become first state to introduce E-Way Bill (EWB) for transportation of gold. This has been made mandatory for the movement of gold and precious stones costing ₹10 lakh and above within the state (intra state) with effect from January 20.

“A new option for generating E-Way Bills (EWB) for gold has been introduced in the EWB system, effective from January 20, 2025. This feature has been made available to facilitate taxpayers in Kerala State to generate EWB for goods classified under Chapter 71, excluding Imitation Jewellery, for intrastate movement, in compliance with the notification issued by the Government of Kerala,” an advisory posted on GST portal said.

An e-way bill is an electronic document generated on a portal, evidencing the movement of goods. It also indicates whether tax has been paid for the moving goods.

As per Rule 138 of the CGST Rules, 2017, every registered person involved in the movement of goods (which may not necessarily be on account of supply) of consignment value of more than ₹50,000 (can be lower for intra-state movement) is required to generate an e-way bill.

The portal further clarified while EWB for movement of gold and precious metal will be generated through “EWB for gold” option only. However the usual system can be used for movement of imitation jewellery.

The latest move is in response to recommendations by GST Council in its meeting on July 11, 2023. It was said that a new section (138F) will be inserted in CGST Act. Similarly, States, which want to mandate requirement of generation of EWB for intra-State movement of gold and precious stones will need to insert a new section in SGST Rules.

Conditions related with EWB said that part-B details of the e-way bill, which typically include transporter information and vehicle details, cannot be updated by default. There is no provision to update transporter information. Also, here is no option to generate a consolidated e-way bill, which allows multiple consignments under a single e-way bill. There is no option to include multiple vehicles for a single e-way bill.

However, the facilities for cancelling and rejecting e-way bills remain the same for moving gold and precious stones. Creating an e-way bill for gold remains the same as other e-way bills. However, taxpayers must not update it with Part-B vehicle/transporter details for safety reasons. Details to be provided include GSTINs of the supplier dispatching the gold or precious stones within the state and the recipient.

Also, the supplier and the recipient’s complete address, including the city, state, and PIN code need to be provided. The unique identification number of the invoice related to the gold or precious stones consignment along with the date of invoice for the gold or precious stones are required to be provided. Details will also include the total value of the gold or precious stones being transported along with the HSN code for gold and precious stones.
